1. About SpicedCoach

SpicedCoach is a sales call coaching tool operated by SpicedCoach (“we,” “us,” or “our”). We analyze call transcripts against the SPICED sales methodology and return structured coaching reports. For questions, contact us at support@spicedcoach.com.

2. Acceptance of Terms

By accessing or using SpicedCoach, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service. These terms apply to all users, including managers, sales representatives, and any other individuals who submit transcripts for analysis.

3. Your Responsibilities

You are solely responsible for ensuring that all participants in any call you submit for analysis have consented to the recording and to the sharing of that recording or transcript with third-party services for analysis purposes. You must comply with all applicable laws regarding call recording consent in your jurisdiction, including but not limited to one-party and two-party consent laws. SpicedCoach does not independently verify consent and bears no liability for your failure to obtain it.

You agree not to submit transcripts that contain personally identifiable health information (PHI), financial account numbers, government-issued ID numbers, or other categories of sensitive personal data beyond what is incidental to a normal B2B sales conversation.

4. AI-Generated Content

SpicedCoach uses artificial intelligence (specifically Claude, developed by Anthropic) to generate coaching reports. AI-generated analysis is provided as a coaching aid only. It reflects methodology alignment based on the content of the submitted transcript and should not be treated as a definitive performance evaluation, a formal HR assessment, or a substitute for human judgment. Reports should be reviewed with a manager before being acted upon.

5. Data Collection and Use

We collect the following information when you use SpicedCoach:

• Transcript content you submit for analysis
• Analysis results generated from your transcripts
• Your email address (used for account management and report delivery)
• Basic usage metadata (timestamps, call identifiers)

We use this data solely to provide the SpicedCoach service. We do not sell your data to third parties. We do not use your transcripts to train AI models. Transcripts are processed by the Anthropic Claude API under Anthropic’s data processing terms.

6. Data Retention

Transcript content is retained for 90 days from the date of submission, after which the raw transcript text is deleted from our systems. Analysis results (scores, coaching points, call summaries) are retained for 12 months. You may request early deletion at any time by contacting support@spicedcoach.com.

7. Intellectual Property

You retain ownership of any transcripts you submit. By submitting a transcript, you grant SpicedCoach a limited, non-exclusive license to process and analyze that content solely for the purpose of providing the service to you. The coaching reports generated by SpicedCoach are provided to you for your internal business use.

8. Limitation of Liability

SpicedCoach is provided “as is” without warranty of any kind. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to decisions made based on AI-generated coaching reports.

9. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or by displaying a notice in the application. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
